Understanding Mutual Consent Divorce in India

Understanding Mutual Consent Divorce in India

Divorce can be a difficult and emotionally challenging decision for a couple. However, when both spouses mutually agree that they cannot continue their marriage and wish to separate amicably, Indian law provides a legal route known as mutual consent divorce.

Mutual consent divorce allows both spouses to jointly approach the court and seek dissolution of their marriage without having to establish allegations such as cruelty, adultery or desertion against each other.

Under the Hindu Marriage Act, 1955, divorce by mutual consent is primarily governed by Section 13B. The provision requires both spouses to jointly agree to the divorce and satisfy certain legal conditions.
